Safeguarding Enquiry

The process undertaken in accordance with the duty under Section 42 of the Care Act 2014 to:

  • establish the facts of the case
  • ascertain the adult’s views and wishes
  • assess the needs of the adult for protection, support and redress and how they might be met
  • protect the adult from the abuse and neglect, in accordance with the wishes of the adult
  • make decisions as to what follow-up action should be taken regarding the person or organisation responsible for the abuse or neglect
  • enable the adult to achieve resolution and recovery

The duty to make an enquiry lies with the Local Authority but it can ‘cause an enquiry to be made’ by other agencies and consideration will be made on a case by case basis as to who the appropriate person would be to undertake the enquiry.
